Chronic inflammatory response syndrome is a serious multisystem condition that can become chronic and cause ongoing impairment. It occurs when your body becomes dysregulated as a result of continued exposure to a damp environment, mold, and microbial toxins.
Often, chronic inflammatory response syndrome develops when you cannot escape a water-damaged building because you work or attend school in one, or because your landlord fails to ensure you have a habitable and safe environment the law guarantees to you.
If you develop this condition, Matthew de Lira can help you to hold those responsible for your exposure accountable for your losses. To find out more, give us a call today to schedule a free consultation with a California mold exposure lawyer.
How does chronic inflammatory response syndrome develop?
Chronic inflammatory response syndrome develops when:
- You are exposed to a water-damaged environment: Damp buildings often contain mold spores, microbial components, dust, and other dangerous substances that can be hazardous to your health.
- These contaminants enter your body through the respiratory tract: When you take a breath, you end up inhaling these microbial components, which then come into contact with mucous membranes.
- Your immune system responds: Your immune system reacts to the potentially harmful material that you have inhaled, triggering an inflammatory response. Unfortunately, in some individuals, the immune system remains activated after this exposure, triggering chronic inflammatory response syndrome.
- The immune system continues to produce inflammatory signals: Your immune system’s inability to regulate can cause system-wide problems. It may alter cytokines, complement proteins, and inflammatory signaling pathways.
- The inflammation begins affecting other body systems: The inflammation can start to affect neurological function, vascular regulation, and hormone signaling
Continued exposure can perpetuate the cycle, causing your body to repeatedly encounter the triggers that set off this cycle. As a result, you may continue experiencing symptoms including headaches, fatigue, memory problems, sleep disturbances, muscle and joint pain, and other serious physical problems even after leaving the building where the mold was located.
What are your rights if you develop chronic inflammatory response syndrome?
If you develop chronic inflammatory response syndrome, treatment involves removing the source of exposure and getting appropriate medical support, which may include taking medications, getting an inhaler for asthma, using binding agents to try to prevent absorption of toxins in the gastrointestinal tract, and taking vasoactive intestinal peptide (VIP).
Treatment can be expensive and time-consuming, and you may experience difficulty working or suffer significant pain as a result of your condition.
If someone else was responsible for your chronic inflammatory response syndrome, you may be able to pursue a claim for damages. Often, this includes taking legal action against a landlord who had an obligation to provide a habitable environment and who failed to do so.
You would need to show:
- The defendant had a duty to you, such as the duty to provide a safe living or working space
- The defendant breached or failed in that duty by not stopping water leaks or remediating mold
- You developed chronic inflammatory response syndrome due to this failure, and you suffered harm as a result
- You experienced damages you can be compensated for
Matthew de Lira can help you to prove all of these elements of your case.
